Transportation Contract Terms

  1. Contract Definition and Purpose

    • This contract is defined as a transportation contract, which refers to the contract where the carrier transports passengers or goods from the place of departure to the agreed place, and the passenger, consignor, or consignee pays the fare or transportation fees.

  2. Carrier's Obligations

    • The carrier must transport passengers or goods safely to the agreed place within the agreed time limit or a reasonable time limit.

  3. Route of Transportation

    • The carrier shall transport passengers or goods to the agreed place via the agreed or usual route of transportation.

  4. Payment of Fare or Transportation Fees

    • Passengers, consignors, or consignees shall pay the fare or transportation fees. If the carrier fails to transport according to the agreed or usual route, thereby increasing the fare or transportation fees, passengers, consignors, or consignees may refuse to pay the increased part of the fare or transportation fees.

  5. Goods Packaging and Information Provision

    • Party A guarantees that the goods are packaged completely, without contamination or damage, and provides the necessary information for transportation.

  6. Carrier's Qualifications and Vehicle Requirements

    • Party B shall possess the legal qualifications to complete the services under this contract and ensure that the carrier vehicles have complete documents, providing copies of all documents.

  7. Transportation Fees and Settlement Method

    • The freight is calculated based on the actual mileage and weight of the goods transported by Party B, with specific standards in accordance with the waybill agreement. Party B, upon delivering the goods to the consignee, shall request a receipt as proof of fulfillment of transportation obligations and settle with Party A using the receipt.

  8. Liability for Breach of Contract

    • If the carrier fails to fulfill the contract obligations, resulting in delays, damage, or loss of goods, they shall bear the corresponding compensation responsibilities as agreed in the contract.
